සුභ උදෑසනක් වේවා මිත්‍රවරුණි, සුපුරුදු පරිදි ඔබ සියලු දෙනා මෙහි පැමිණ සිටීම ගැන අපි ඉතාමත් සන්තෝෂ වෙනවා.
අද අපි කාරණා 3 ක් සම්බන්ධයෙන් ඔබට තොරතුරු ලබාදෙන්න සූදානම් කරලා තියෙනවා.
පළමුව, අපි ගිය සතියේ ඔබට දැනුම් දුන් පරිදි, විදේශ කටයුතු අමාත්‍යාංශයේ අමාත්‍යවරයා ගරු මංගල සමරවීර මැතිතුමා අද සිට, එනම් ජූනි මස 17 වන දින සිට 20 වන දින දක්වා ජපානයේ සංචාරයක යෙදෙනවා. එතුමා ජනාධිපති ගරු මෛත්‍රිපාල සිරිසේන මැතිතුමාගේ ආණ්ඩුවේ විදේශ කටයුතු ඇමති ලෙස පත්වීමෙන් පසු ජපානයේ සංචාරයක යෙදෙන පළමුවෙනි අවස්ථාව මෙයයි. මෙම සංචාරය ටෝකියෝ නගරයට පමණක් සීමාවුණු සංචාරයක්. එතුමා මෙම සංචාරයේ යෙදෙන්නේ ජපානයේ විදේශ අමාත්‍ය ගරු ෆුමියෝ කිෂිඩා මහතා කරන ලද ආරාධනයක් මතයි.
මෙම සංචාරයේ ප්‍රධානම අරමුණ වනුයේ විදේශ ඇමති කිෂිඩා සමඟ පවත්වනු ලබන ද්විපාර්ශ්වීය සාකච්ඡා වන අතර ඊට අමතරව ඔහු සාකච්ඡා කිරීමට නියමිත පුද්ගලයින් වනුයේ:
- අභ්‍යන්තර කටයුතු සහ සන්නිවේදන කටයුතු සම්බන්ධ ඇමතිතුමා ( ගරු සනෙයි ටකයිචි)
- ජයිකා ආයතනයේ සභාපතිතුමා (අකිහිකෝ ටනකා මැතිතුමා)
- ජපාන - ශ්‍රී ලංකා පාර්ලිමේන්තු සංගමයේ සභාපතිතුමා සහ එහි ජ්‍යෙෂ්ඨ සාමාජිකයින්
- ජපාන විදේශ වෙළෙඳ සංගමයේ සභාපතිතුමා (හිරෝයුකි ඉෂිගේ මැතිතුමා)
- ජපාන - ශ්‍රී ලංකා සංගමයේ හිටපු සභාපති සහ ජපානයේ හිටපු අගමැතිවරයකු වන, ශ්‍රී ලංකාව සමඟ ඉතාමත් කිට්ටු සම්බන්ධතාවයක් දීර්ඝ කාලයක් සිට පවත්වාගෙන යනු ලැබු ගරු යසුඕ ෆුකුඩා මහතා.
සමරවීර ඇමතිතුමා, ජපාන - ශ්‍රී ලංකා ව්‍යාපාරික සහයෝගිතා කමිටුවේ සාමාජික සමාගම්වල නිලධාරීන් ද හමුවීමට නියමිතයි. මේ අතර දැනටමත් ශ්‍රී ලංකාවේ ආයෝජනය කර ඇති ආයතන නියෝජනය කරන පුද්ගලයින් සහ අනාගත ආයෝජකයන් ද සමඟ සාකච්ඡා පැවැත්වීමට නියමිතයි.
එසේම එතුමා මාධ්‍ය සමඟ අන්තර්ක්‍රියා මාලාවක්ම පැවැත්වීමට නියමිතයි.
- ජූනි මස 19 වන දින පෙරවරු 11ට ජපානයේ ජාතික මාධ්‍ය සමාජයේ නැත්නම් National Press Club හි මාධ්‍ය හමුවකට සහභාගිවීමට නියමිතයි.
- එසේම Yomiuri, Nikkei හා Asahi Shimbum යන ප්‍රවෘත්ති පත්‍ර නියෝජනය කරන මාධ්‍යවේදීන් සමඟත් මාධ්‍ය සාකච්ඡා පවත්වන්නට නියමිතයි.
- NHK රූපවාහිනියේ ද සම්මුඛ සාකච්ඡාවක් පැවැත්වීමට එතුමා එකඟ වී තිබෙනවා.
ජූනි මස 19 වන දින සවස ඇමතිතුමා, ජපාන අග්‍රාමාත්‍ය ගරු ෂින්සෝ අබේ මහතා මුණ ගැසීමට නියමිතයි. මෙහිදී, එතුමා සමඟ, ජපානයේ විදේශ ඇමතිතුමාගේ ආරාධනාව පිළිගනිමින් “ආසියාවේ සාමය ගොඩනැගීම, ජාතික සංහිඳියාව හා ප්‍රජාතන්ත්‍රීකරණය පිළිබඳව ඉහළ පෙළේ සම්මන්ත්‍රණය”ට සහභාගිවීමට නියමිත විද්වතුන් සහ ඇතැම් කථිකයන් ද අගමැතිතුමා මුණගැසීමට නියමිතයි.
මංගල සමරවීර ඇමතිතුමාට 20 වන දින උදෑසන මෙම සම්මන්ත්‍රණය ඇමතීමට ජපාන විදේශ කටයුතු අමාත්‍යංශය කටයුතු සූදානම් කර තිබෙනවා. එතුමා මෙහිදී ප්‍රජාතන්ත්‍රීකරණය සහ සංහිඳියාව සම්බන්ධයෙන් ශ්‍රී ලංකාවේ අත්දැකීම් පිළිබඳව අදහස් ප්‍රකාශ කිරීමට නියමිතයි.
ශ්‍රී ලංකා සහ ජපාන විදේශ ඇමතිවරු ජපානයෙන් ශ්‍රී ලංකාවට ලබාදෙන ආර්ථික ආධාර සම්බන්ධ ගිවිසුම් දෙකකට අත්සන් කෙරෙනු ඇතැයි බලාපොරොත්තු වෙන අතර මෙම ගිවිසුම් පිළිබඳ ස්ථිර තීරණ ගෙන අත්සන් තැබූ විට ඔබට මේ සම්බන්ධව ඉක්මණින් විස්තර ලබාදෙන්න අපි උත්සාහ කරනවා.
දෙවැනි කාරණය තමයි
ඔබ සියලු දෙනාම දන්නා පරිදි එක්සත් ජාතීන්ගේ මානව හිමිකම් කවුන්සලයේ සාමාන්‍ය සැසිවාරය දැන් පවත්වාගෙන යනු ලබනවා. මෙම 29 වන සැසිවාරය ජූනි 15වන සඳුදා ආරම්භ වූ අතර ජූලි මස 3 වන සිකුරාදා සැසිවාරය අවසන් වීමට නියමිත යි.
සාමාන්‍ය සම්ප්‍රදායට අනුකූලව, මානව හිමිකම් සම්බන්ධව කටයුතු කරන මහ ලේකම් සෙයිඩ් රාඩ් අල් හුසේන් මහතා ජූනි 15 වන දින, සමාරම්භක සැසිවාරයේ මානව හිමිකම් කවුන්සලය ආමන්ත්‍රණය කෙරුවා.
එහිදී ඔහු රටවල් කිහිපයක මානව හිමිකම් පිළිබඳ ව ඇති ප්‍රශ්න සම්බන්ධයෙන් කතා කළ අතර, මානව හිමිකම් පිළිබඳව තේමාවන් කිහිපයක් පිළිබඳ ප්‍රශ්නවලටත් අවධානය යොමු කර සිටියා.
ශ්‍රී ලංකාව සම්බන්ධයෙන් ඔහු මෙසේ ප්‍රකාශ කර සිටියා:
“ශ්‍රී ලංකාවේ නව රජය ඇති කළ ව්‍යවස්ථාදායක සංශෝධනය නිසි ආකාරව ක්‍රියාත්මක කළහොත් ප්‍රජාතන්ත්‍රවාදය සහ නීතිය පිළිබඳව අලුත් බලාපොරොත්තුවක් තැබිය හැකිය.
විනිවිදභාවයෙන් යුතු වූත් සියලුම දෙනා එකතුකොට සකසා ගන්නා ක්‍රියාවලීන් තුළින් වගකිවයුතුභාවය හා සංහිඳියාව සම්බන්ධ විශ්වාසනීය යාන්ත්‍රණ සකස් කිරීම පිළිබඳ අවශ්‍යතාවය පිළිබඳව ලබන සැප්තැම්බර් මාසයේ මා විසින් ලංකාව පිළිබඳ ව ඉදිරිපත් කරන වාර්තාව ගෙන එන අවධියක මාගේ කාර්යාලය දිගින් දිගටම ශ්‍රී ලාංකික බලධාරීන් සමඟ සාකච්ඡාවල එලඹී සිටියි.
මා ලංකාවේ රජයට උනන්දු කරන්නේ ඉතා පුළුල් සාකච්ඡාවක් මඟින් දේශපාලන පක්ෂ, සිවිල් සංවිධාන සහ විශේෂයෙන්ම අනතුරට පත්වූ අය සහ ඔවුන්ගේ ඥාතීන් එකතුකොට ගෙන එමඟින් ජාතික වශයෙන් සහභාගි වූ ක්‍රියාවලියක් ඉටු කිරීමත් එයට සැමගේම හිමිකාරිත්වය ලබාදීමටත්ය.”
මහකොමසාරිස්තුමාගේ අදහස් වෙත අපි අවධානය යොමුකර තිබෙනවා.
අපි මීට පෙර අවස්ථාවලදීත් ඔබට කියා සිටි පරිදි අදාළ ඉහළ මට්ටමේ බලධාරීන් මේ කරුණු සම්බන්ධයෙන් දැනට සාකච්ඡා පවත්වන අතර සියලු පාර්ශ්වකරුවන්ගේ අදහස් විමසීමට අවශ්‍ය බවත්, නිසි කලට එසේ කිරීමට ඇති අවශ්‍යතාවය සම්බන්ධ ව හොඳ වැටහීමකින් කටයුතු කරමින් පවතින බවත් අපි ප්‍රකාශ කරන්න කැමතියි.
තුන්වන කාරණය
ගිය සතියේ මාධ්‍ය හමුවේදී පැන නැඟු එක ප්‍රශ්නයක් තමයි ජිනීවා නගරයේ ශ්‍රී ලංකා තානාපති කාර්යාලයේ නිත්‍ය නියෝජිත ලෙස සේවය කළ මේ අමාත්‍යාංශයේ ශ්‍රී ලංකා විදේශ සේවයේ ජ්‍යෙෂ්ඨ නිලධාරිනියක් වන ක්ෂෙණුකා සෙනෙවිරත්න මැතිනියට විරුද්ධව ඇතැම් පාර්ශ්ව සහ පුද්ගලයන් නැඟූ චෝදනා.
මෙම චෝදනාවලින් කියවුණේ එතුමිය නිත්‍ය නියෝජිත නිල නිවසේ අලුත්වැඩියා කටයුතු පිළිබඳ කොන්ත්‍රාත්තුව LTTE සංවිධානයට සම්බන්ධ පුද්ගලයෙකුගේ ආයතනයක් වන SHELVAZVG GMBH යන ආයතනයට භාරදීමට ඇයගේ සේවා කාලය තුළ දී කටයුතු කළ බව
සහ
එතුමියගේ ස්වාමිපුරුෂයා එම සමාගමේ උප කොන්ත්‍රාත්කරුවෙකු ලෙස ක්‍රියාකර ඇති බවත්.
තවද මෙම අලුත්වැඩියා කටයුතු පිළිබඳව නිසි ගිණුම් පටිපාටි අනුගමනය නොකර ඇති බවට ද චෝදනා පැන නැඟුණා.
මෙම චෝදනා පැන නැඟීම පදනම් වූයේ 2012 වසරේ 13-14 ... පෙබරවාරි 13-14 යන දිනයන්හි එම නිත්‍ය නියෝජිත කාර්යාලයේ කෙරුණු කළමනාකාර විගණනයන් මත ඉදිරිපත් කරනු ලැබුනු 2012 වසරේ අප්‍රේල් මස 30 වන දිනැති විගණන වාර්තාවක් මතයි. මෙම විගණනය කර ඇත්තේ සම්පූර්ණයෙන් ම මුල්‍ය අමාත්‍යාංශයේ නිලධාරීන්ගෙන් සමන්විත වූ කණ්ඩායමක් විසින්. මෙම කණ්ඩායමේ ප්‍රධාන නිලධාරියා වූයේ එම්.ඩී.විදානගමාච්චි නැමැති එවකට සිටි නියෝජ්‍ය භාණ්ඩාගාර ලේකම්තුමා.
ඔවුන් නිකුත් කළ වාර්තාවේ මෙසේ සඳහන් වුණා.:
“මෙම ටෙන්ඩරය LTTE සංවිධානයේ ක්‍රියාකාරිකයෙකු වූ පී.ටී.තුරෙයිරාජා මහතාට ලබාදී ඇති බව පැහැදිලියි. තුරෙයිරාජා මහතා ඇත්ත වශයෙන්ම ඔහුගේ ... LTTE සංවිධානයට සම්බන්ධ ක්‍රියාකාරකම් හේතුවෙන් ස්විට්සර්ලන්ත බලධාරීන් විසින් අත්අඩංගුවට ගෙන ඇත.”
මෙම විගණනයේ සමාරම්භය පිළිබඳව එවකට, එනම් අගෝස්තු 2011 සිට ජූලි 2012 දක්වා ජිනීවා හි නිත්‍ය නියෝජිතවරිය ලෙස ක්‍රියා කළ ටමාරා කුණනායගම් මහත්මිය මාධ්‍ය අමතා මෙසේ ප්‍රකාශ කර සිටියා.
“මම ජනාධිපතිතුමාට කියා සිටියා මට නිල නිවාසයේ විගණනය සම්බන්ධයෙන් සහ ආරක්ෂාව සම්බන්ධයෙන් ප්‍රශ්න ඇති බව. මම විගණනයක් සිදු කිරීමට අවශ්‍ය බව කියා සිටියා. විශේෂයෙන්ම මම ජනාධිපතිතුමාට කියා සිටියා මට විදේශ කටයුතු අමාත්‍යාංශය හරහා මෙම විගණනය කරගැනීමට අවශ්‍ය නැති බව. ජනාධිපතිතුමා එවිට මූල්‍ය අමාත්‍යාංශයෙන් කණ්ඩායමක් එව්වා. එම නිලධාරීන් වහාම එහි පැමිණියා.”
මෙසේ කියා සිටියේ ටමාරා කුණනායගම් මැතිණිය
දැන් ... එතුමිය අනුගමනය කළ ක්‍රියාමාර්ග පරිපාලන ක්‍රියාවලීන්ට පටහැනියි. මන්ද, තානාපතිධූරය දරන්නෙක් හැමවිටම පරිපාලන සහ විගණනය සම්බන්ධව ගැටළුත් අනෙකුත් කරුණු සම්බන්ධයෙන් පළමුවෙන්ම, පරිපාලන රීතිවලට අනුකූලව විදේශ කටයුතු අමාත්‍යාංශය හරහා ක්‍රියා කළ යුතුවෙනවා.
ඔබ දන්නා පරිදි කුණනායකම් මහත්මිය මෙම කළමනාකරණ විගණන වාර්තාවේ අන්තර්ගත කරුණු පදනම් කරගෙන සෙනෙවිරත්න මැතිණියට විරුද්ධව මාධ්‍ය හරහා විශාල ව්‍යාපාරයක් කරගෙන ගියා.
මෙම තත්ත්වය යටතේ ජාතික විධායක සභාව සහ Anti-Corruption ලේකම් කාර්යාලය විසින් කරන ලද ඉල්ලීම් මත සහ විදේශ කටයුතු ඇමතිතුමා සහ නියෝජ්‍ය විදේශ කටයුතු ඇමතිතුමා විසින් ද මේ සම්බන්ධයෙන් පරික්ෂණයක් පැවැත්වීමට තීරණය කෙරුවා. ක්ෂෙණුකා සෙනෙවිරත්න මැතිනිය, තායිලන්තයේ ශ්‍රී ලංකා තානාපති ලෙස පත් කිරීම සුදුසු ද යන්න තීරණය කිරීමට මෙම පරික්ෂණය පැවැත්විය යුතු බව තමයි තීරණය කළේ.
මේ සඳහා විදේශ කටයුතු අමාත්‍යාංශයේ ලේකම්තුමිය ආයතන සංග්‍රහයට අනුකූලව, රාජ්‍ය සේවා කොමිෂන් සභාවේ ද සහාය ඇතිව, ඩී.එච්.බී.එදිරිසිංහ යන විශ්‍රාමික - ශ්‍රී ලංකා ගණකාධිකාරී සේවයේ කොමසාරිස්වරයෙක් මේ ගැන පරීක්ෂණයක් පැවැත්වීමට පත් කරනු ලැබුවා.
මොහු පරීක්ෂණයේ දී ප්‍රශ්න කරන ලද සියලු නිලධාරීන්ගේ සහ පුද්ගලයන්ගේ ලැයිස්තුවක් ඔහු ඉදිරිපත් කළ වාර්තාවේ අන්තර්ගතයි.
ඔහු පරීක්ෂණයෙන් පසු ඉදිරිපත් කළ නිර්දේශ මම ඔබට සම්පූර්ණයෙන් ම කියවන්නම්
නිර්දේශ
1.ජිනීවා හි පිහිටි නිත්‍ය නියෝජිත නිල නිවසේ සිදුකරන ලද අලුත්වැඩියාව කේ.ඩී.සෙනෙවිරත්න මහත්මිය ජිනීවා හි එක්සත් ජාතීන්ගේ සංවිධානයේ නිත්‍ය නියෝජිතවරිය ලෙස කටයුතු කරන වකවානුවේදී සම්පූර්ණයෙන්ම සිදුකරන ලද්දක් නොවේ. අලුත්වැඩියාව සඳහා කොන්ත්‍රාත්කරු තෝරා ගැනීම සඳහා සියලු කටයුතු ඇය එම තනතුරේ වැඩ බාරගත් 2009.11.16 වන දිනට පෙර සිදුවී ඇත. එමනිසා එම පියවර දක්වා කටයුතු සියල්ලම සිදුවී ඇත්තේ ඇයගේ ඉල්ලීමක් මත හෝ ඒ පිළිබඳ සුළු දැනුමක් හෝ ඇය සතුව තිබියදී නොවන බව ස්ථිර ලෙසම පැහැදිලිය. එලෙසම තෝරාගත් කොන්ත්‍රාත්කරු පිළිබඳ තොරතුරු සොයා බැලීම හා ප්‍රදාන ලිපිය නිකුත් කිරීම ද පළමු හා දෙවන ගෙවීම් කොන්ත්‍රාත්කරුට ගෙවීම් ද ඇයට පැවරුණ වෙනත් රාජකාරි හා ලබාගත් නිවාඩු නිසා ඇයට නොහැකි වී ඇත. මෙම අලුත්වැඩියාවට අදාල තෙවන ගෙවීම කිරීමේ දී ඇය විසින් ද සොයා බලා අඩුපාඩු කොන්ත්‍රාත්කරු ලවාම සම්පූර්ණ කරවා ගෙන නිසි පරිදි කටයුතු කර ඇති බවට සෑහීමට පත් වීමෙන් පසු ව වවුචරය අනුමත කර ඇති බවද, එසේම රඳවා ගත් මුදල් (10%) ආපසු ගෙවීමේදී ඇය පෞද්ගලිකවම සොයා දෝෂ නැති බව තහවුරු කරගෙන වවුචරය අනුමත කර ඇති බවද පැහැදිලි වේ. ඒ නිසා අලුත්වැඩියාව සම්බන්ධ කටයුතුවල සෑහෙන කොටසක් ඇය රාජකාරි භාරගැනීමට පෙර සහ ඇය ජිනීවාවලින් බැහැරව සිටින අවස්ථාවලදී සිදුවීමත් ඇය අනුමත කළ වවුචර නිසි සොයා බැලීමකින් හා අදාල ලේඛනවලින් තහවුරු කරගෙන ඉතා නිවැරදිව කර ඇති නිසාත් මෙම අලුත්වැඩියාවට අදාල ක්‍රියාවලිය සම්බන්ධයෙන් කිසියම් අඩුපාඩුවක් තිබුණහොත් ඒවා සඳහා වගකීමෙන් කේ.ඩී.සෙනෙවිරත්න මහත්මිය නිදහස් විය යුතු බව නිර්දේශ කරමි.
2.භාණ්ඩාගාර නිලධාරීන්ගේ කළමනාකරණ විගණන වාර්තාවේ මෙම අලුත්වැඩියාව හැර අනෙකුත් ප්‍රසම්පාදන කටයුතු විධිමත්ව සිදුනොවන බව දක්වා ඇත. ඒ නිසා විදේශ දූත මණ්ඩලවල පවතින අහයපත් ප්‍රසම්පාදන ක්‍රියා පිළිවෙත වැළැක්වීමට පහත ක්‍රියා මාර්ග ගැනීම යෝග්‍ය බව නිර්දේශ කරමි.
2.1 ප්‍රසම්පාදන විෂය හා විදේශ දූත මණ්ඩලවල කටයුතු පිළිබඳ විශේෂ දැනුම ඇති නිලධාරීන්ගෙන් සමන්විත කමිටුවක් මගින් විදේශ දූත මණ්ඩල සඳහා විශේෂ වූ ප්‍රසම්පාදන මාර්ගෝපදේශ පිළියෙල කර භාණ්ඩාගාරයේ එකඟත්වය ලබාගෙන ක්‍රියාවේ යෙදවිම.
2.2 ඉහත 2.1 සඳහන් කටයුත්ත සඳහා කාලයක් ගතවිය හැකි බැවින් ඉහත අඩුපාඩු අඛණ්ඩව සිදුවීම අවම කිරීම සඳහා අදාල නිළධාරීන් සාකච්ඡා කර දැනට පවතින ඒවාට වඩා හොඳ වූ ක්‍රියාමාර්ග අනුගමනය කිරීම සඳහා ඉක්මණින් උපදෙස් දීම
උදාහරණ:-
ටෙන්ඩරයක් සඳහා දූත මණ්ඩලය මගින් ලංසු ලබාගැනීම මුද්‍රා තැබූ කවර මගින් කර එවා විවෘත නොකර කෙළින්ම අමාත්‍යාංශයට එවා කොළඹ සිටින නිළධාරීන්ගෙන් සමන්විත විධිමත් ව පත් කළ තාක්ෂණික ඇගයීම් කමිටුවක් මගින් ලංසු ඇගයීම් කර වාර්තාව ටෙන්ඩර මණ්ඩලයට ඉදිරිපත් කිරීම. එසේම කොන්ත්‍රාත්කරු හා දූත මණ්ඩලය අතර අත්සන් කළ යුතු ගිවිසුම සඳහා පොදු ආකෘතියක් අමාත්‍යාංශය මගින් හඳුන්වා දිය හැක.
3.අලුත්වැඩියාවේ කොන්ත්‍රාත්කරු වූ පී.ටී.තුරෙයිරාජා මහතා LTTE ක්‍රියාකරුවෙකු බව බොහෝ අවස්ථාවල චෝදනා නැගුනත් ඉහත විස්තර කර ඇති පරිදි එවැනි සැකයක් හෝ ඇතිවී ඇත්තේ මෙම කොන්ත්‍රාත්තුවට සම්බන්ධ ජිනීවා කාර්යාලයේ කටයුතු සියල්ල අවසන් වූ 2010.07.05 වන දිනට පසුව 2011 වර්ෂයේදීය. ඒ නිසා ඇත්ත වශයෙන්ම ඔහු LTTE ක්‍රියාකරුවෙකු වුවත් ඔහු ගැන සැක කිරීමට පටන් ගෙන ඇත්තේ මෙම කොන්ත්‍රාත්තුවේ සියළු කටයුතු අවසානයේ දී නිසා ශ්‍රී ලංකා රජයේ සතුරෙකු වන LTTE ක්‍රියාකරුවෙකුට ජිනීවා හි නිත්‍ය නියෝජිත නිල නිවස අලුත්වැඩියාව සඳහා යොදවන ලදැයි යන චෝදනාව සම්බන්ධයෙන් ජිනීවා නිත්‍ය නියෝජිත කාර්යාලයේ එකල සේවය කළ කිසිදු නිළධාරියෙකු චෝදනා ලැබිය යුතු හෝ වගකිව යුතු බව පැවසීම සාධාරණ නොවන බව නිර්දේශ කරමි.

Remarks to Media (In English) (20:48 onwards)
Good morning friends. As usual, it’s very nice to see all of you here today. There are three issues that we will cover.
(I)
The first, is that last week , we informed you, that the Hon. Minister of Foreign Affairs, Mr. Mangala Samaraweera, will be visiting Japan from the 17th to the 20th of June 2015, on his first visit to that country, since he assumed office as the Minister of Foreign Affairs of President Maithripala Sirisena’s Government.
This visit, as we informed you, takes place at the invitation of the Minister of Foreign Affairs of Japan, Hon. Fumio Kishida. Apart from bilateral discussions with Foreign Minister Kishida, the Minister will have meetings with the Minister for Internal Affairs and Communications Hon. Takaichi; the President of JICA Mr. Akihiko Tanaka; the President and Senior Members of the Japan-Sri Lanka Parliamentary League; the Chairman of the Japan External Trade Organisation Mr. Hiroyuki Ishige; and Former Prime Minister of Japan, Mr. Yasuo Fukuda who has been a very close friend of Sri Lanka and a former President of the Japan-Sri Lanka Association.
Minister Samaraweera will also meet with Member Companies of the Japan-Sri Lanka Business Cooperation Committee. Several representatives of leading companies who already have investments in Sri Lanka as well as potential investors are expected to participate at this meeting.
The Minister will have a series of interactions with the media, during this visit. He will hold a Press Conference at the Japan National Press Club in Tokyo on the 19th of June at 11 am (Tokyo time) and have separate interviews with the Yomiuri, Nikkei, and Asahi Shimbum newspapers. He will also be interviewed by NHK Television.
On the 19th evening, the Minister will call on the Prime Minister of Japan H.E. Shinzo Abe. This will be a joint courtesy call, together with some of the panelists and speakers at the ‘High Level Seminar on Peacebuilding, National Reconciliation and Democratization in Asia’ which the Minister will be addressing at the invitation of the Minister of Foreign Affairs of Japan. The Minister’s address at the High Level Seminar will be on the 20thof June. He will focus on Sri Lanka’s experience of reconciliation and democratization.
The Ministers of Foreign Affairs of Sri Lanka and Japan are expected to sign two agreements on Japanese economic assistance to Sri Lanka. Details in this regard will be provided to you in due course.
(II)
The second issue is that as you are aware, the UN Human Rights Council is currently in session. The 29thregular session of the Council opened on Monday 15th June and will continue until Friday 3rd July.
In keeping with usual practice, the High Commissioner for Human Rights, Mr. Zeid Ra’ad Al Hussein, addressed the Council at the inaugural session on 15th of June.
In his address, the High Commissioner referred to human rights related issues in several countries and he also spoke of thematic areas of concern.
Referring to Sri Lanka, the High Commissioner stated the following:

“The new Government in Sri Lanka has passed a constitutional amendment which, if implemented appropriately, brings renewed hope for democracy and the rule of law. OHCHR, that is the Office of the High Commissioner for Human Rights, will remain very engaged in discussions with the Sri Lankan authorities on the need for transparent and inclusive processes to develop credible mechanisms for accountability and reconciliation, ahead of my report to the September session. I encourage the Government to consult broadly with all political parties, civil society, and above all victims and their families, to ensure full national support and ownership of these processes.”

The High Commissioner’s reference to Sri Lanka has been noted.
As we have informed you on previous occasions, relevant authorities, at high-level, continue to be engaged in internal consultations on these matters. They also recognize the need to consult all stakeholders on these issues, in time.
(III)
The third issue, you would recall that, at last week’s media briefing, there was interest expressed to ascertain the status of the inquiry with regard to allegations made by some, that Mrs. Kshenuka Senewiratne, a senior Foreign Service officer of this Ministry, during her tenure as Sri Lanka’s Permanent Representative to the UN in Geneva, was involved in awarding a contract to carry out repairs to the official residence of the Ambassador, to the Company named Shelvazug GmBH, headed by a person associated with the LTTE.
Further, it was alleged that Mrs. Senewiratne’s husband had been sub contracted by the aforementioned Company.
In addition, it was further alleged that proper accounting procedures had not been followed with regard to the repairs.
These allegations resulted from a Management Audit Report of 30th April 2012, following an Audit carried out from 13 to 14 February 2012, by a four member team entirely comprising officials from the Ministry of Finance, headed by Mr. D. Vidanagamachchi, the then Deputy Secretary to the Treasury.
The Report had a reference as follows:

“It is evident that this tender has been awarded to a LTTE activist Mr. P.T. Thurairajah. Mr.Thurairajah had in fact been taken into custody by the Swiss authorities in connection with his LTTE involvements”.

In a media interview on how this Audit originated, Ms. Tamara Kunanayakam, who served as the Permanent Representative to the UN in Geneva from August 2011 to July 2012, stated as follows:
I quote
“I told the President I have an issue about the audit and security of the official residence. I wanted an Audit carried out and specifically told the President that I don’t want the Ministry of External Affairs to do it and the President sent a group from the Finance Ministry. They came immediately.”

This action, as you are aware, is not in keeping with stipulated practice where a Head of Mission is required to recourse primarily to the Ministry of Foreign Affairs for all administrative and substantive issues pertaining to the Mission and its work.
As all of you are aware, Ms. Kunanayakam spearheaded a media campaign of vilification of Mrs. Senewiratne, purportedly based on the contents of this Management Audit Report.
In this backdrop, in order to establish the suitability of Mrs. Senewiratne as the Ambassador-designate of Sri Lanka to the Kingdom of Thailand, following requests from the National Executive Council and the Anti-Corruption Secretariat and subsequent to the undertakings given by both the Hon. Minister and the Hon. Deputy Minister of Foreign Affairs, an inquiry was instituted with regard to the allegations levelled against her.
For this purpose, the Secretary of the Ministry of Foreign Affairs appointed Mr. D.H.B. Edirisinghe, a retired Sri Lanka Accountants’ Service Commissioner as the Investigating Officer, in accordance with Section 13 of the Establishment Code, Section 13 Chapter XLVIII of the Establishment Code with the facilitation of the Public Service Commission to investigate the case.
Details of the persons questioned are listed in the Report which can be made available to anyone who is interested. Following the investigation, the recommendations made are as follows :-
I will now read out to you that section in its entirety:
1.The complete work related to the refurbishment of the official residence of the Permanent Representative in Geneva had not been done entirely during the tenure of office of Mrs. K.D. Senewiratne. Everything up to the selection of a contractor for the refurbishment work had been done before her assumption of duties in the position on 16.11.2009. Hence it is quite evident that such steps had been taken not at her request and that she was least aware of the facts. Further she had not been able to attend to the work entrusted to her with regard to the revelation of the information regarding the selected contractor, issue of the letter offering the contract and effecting the first and second payments due to other urgent commitments and the leave she had obtained. There is evidence to the fact that she had personally examined the work done before making the third payment related to the refurbishment of the residence and had got the contractor to attend to the lapses; and before releasing the 10% retention money she had ensured sorry before releasing the 10% retention money she had ensured and satisfied herself that there were no lapses and had approved the voucher only thereafter. Under such circumstances, since a substantial part of the activities relating to this refurbishment had been done before the assumption of duties by Mrs. Senewiratne and during the time when she was away from Geneva, I recommend that Mrs. K.D. Senewiratne should be exempted from any lapses with regard to the activities related to this refurbishment.
2. It is mentioned in the Management Audit Report that not only this refurbishment but also other refurbishments are not being carried out properly. In order to avoid the improper procurement procedure, the following course of action is recommended.
1- Preparation of special procurement guidelines for overseas missions through a committee consisting of officials with expert knowledge on the tasks and procedures relating to the subject of procurement and overseas Missions and bringing them into practice with the approval of the Treasury.
2- Since the task mentioned in 1 above may take some time, discussions may be held with relevant officials with a view to minimizing the repetition of above lapses and prompt advices may be provided to them to follow more adequate procedures than the existing ones.
E.g.:- Receiving bids for a tender through the mission. These should be received in sealed envelopes and should be sent directly to the Ministry without the Missions opening them. Bids should be evaluated by a formally appointed Technical Evaluation Committee consisting of officials in Colombo. Further, the Ministry can introduce a common format for the agreement to be signed between the contractor and the Mission.
3. Although allegations that Mr. P.T. Thurairajah was an LTTE activist were raised on many occasions, as explained above, a suspicion to that effect had emerged only in 2011 that is after 05 July 2010 when all the work in the Geneva office had been concluded. Hence, even if he had actually been an LTTE activist, the suspicion against him would have started to emerge only after the conclusion of all the activities related to this contract. Therefore, it is not justifiable to come to the conclusion that any official who served in the Office of Geneva Permanent Representative at that time should be made an offender or held responsible of the allegation that an LTTE activist who is regarded as an enemy of the government of Sri Lanka had been deployed in the refurbishment work of the residence in the Office of the Permanent Representative in Geneva.
4. There are many documents revealing that Mrs. K.D. Senewiratne in the capacity of the then Permanent Representative and Mr. U.L.M. Jauhar in the capacity of the Head of Chancery had worked with care, consequent to the publication of various media statements regarding the arrest of 10 persons as LTTE suspects in Switzerland in January 2011. This fact is substantiated by documents No. 24, 25, 26 and 27. Further, the reply of the Ministry of Defense to the inquiry by letter L/POL/236 VOL. iii dated 05th June 2015 sent by the Director General (Legal Division) of the Ministry of Foreign Affairs to the Secretary Ministry of Defense will reveal whether Mr. P.T. Thurairajah, the contractor is an LTTE activist or not. Therefore, I recommend that it is appropriate to draw the attention to the reply which is due to be received from the Ministry of Defense in pursuing future work in this regard.
5. It is recommended that it is appropriate to regard the allegation that the husband of Mrs. K.D. Senewiratne had been a sub-contractor to Mr. P.T. Thurairajah for this refurbishment as a baseless point which had been fabricated purposefully.
The letter that, from the Ministry of Defence that he refers to in his report, was received by us after he submitted the Report and I will read out to you what it says “you are kindly informed that the under mentioned individual is not listed as a designated person under the UNHCR 1373” - that is Mr. P.T. Thurairajah.
The Report following this investigation was submitted to the Committee on High Posts of the Parliament and to the National Executive Council.
Mrs. Senewiratne was requested to present herself before the Committee on High Posts on Friday 12 June 2015. The Committee, having examined the Investigation Report, found Mrs. Senewiratne suitable to hold the post of Ambassador of Sri Lanka to the Kingdom of Thailand.

Q: Shihar from Reuters, what is the update on the domestic war crimes investigation process?
A: We don’t have an update from what we have told you already, and as I said, this is being discussed at high level and the High Commissioner’s comments have been taken note of and the person concerned are also seized of the matter on the need to have wider consultations at the appropriate time.
Q: I’m Hazari from TNL Radio, it is a question similar in line to what he asked just now, since he made … mentioned about the UNHRC and the Council which is under way, currently. The last government had same issues related to the alleged human rights violations during the conflict and the present government did prolong or delay the report which was supposed to be submitted earlier this year to September. So what sort of progress has the present government made regarding this report?
A: The report is a report which is to be submitted to the High Commissioner’s office?
Q: I am talking about the internal investigation which is the basis of delaying the report earlier this year,..
A: As you are aware, the reason for the establishment of an OHCHR led investigation was because there was a feeling or there was perception, widely felt perception, among the international community that the Government of Sri Lanka at the time was not keen on implementing the recommendation of the LLRC report and that the government was not serious enough in expediting the reconciliation programme or addressing the issues of those who are affected by conflict, specially, in the North and East of the country.
So these are the circumstances under which the Resolution in March 2014 was adopted and as you know, the High Commissioner, as he has been instructed by that Resolution by Member States, has to present a report. He was supposed to present this report in March this year to the Human Rights Council session. At the request of the new government, the High Commissioner decided to allow the new government to implement its own policies, as you know the government canvassed on a platform of democratization, repealing the 18th amendment, strengthening civilian administration, strengthening Human Rights, rule of law, good governance practices so on. So it was felt that the government should be given some time to start implementing what it had promised and the report will be submitted by the High Commissioner in September and our assumption is that, as you have seen, the international community is also aware of the changes that are happening in Sri Lanka. This is why you see among the International community, a remarkable or significant shift in the way they approach Sri Lanka.
Sri Lanka is more willing to engage with everybody, including domestic and international NGOs in discussing issues with them. They are more open to listening to what they have to say, to listen to their ideas and also and they have also implemented a lot of new proposals, I mean, new, what shall I say, a new reform agenda in which includes the 19th amendment, which was one of the main undertaking of the government and you see that there is a shift in the international community in the way they approach Sri Lanka, the way they respond to Sri Lanka and the way they engage with Sri Lanka, which is why also.. you saw the Secretary of State of the Unites States visiting Sri Lanka.
So, our assumption is that all these things that are happening, the developments, Progress in the North and East, as well as everywhere else in the country as a whole, would be taken into account by the international community when they make a decision in September.
Q: As you made mention, about the progress Sri Lanka is going to make, leave aside the LLRC report, if I am not mistaken, an assurance was given about the internal investigation, but we cannot see any tangible progress in terms of internal investigation regarding the alleged Human Rights Violation during the conflict.
A: Well, if you look at the letter that the Minister wrote to the High Commissioner on the 13th of February this year, you would see that a lot of the undertakings have already be implemented.
Q: Can I have a couple of points on that?
A: One, we undertook to, well, even before he wrote the letter, he had already extended an invitation to the High Commissioner of Human Rights to visit Sri Lanka. That itself ..., it is remarkable shift because we were willing to engage with him on addressing issues which previously we were not even willing to discuss.
Two, we extended an invitation to the working group on enforced and voluntary disappearances. Now the dates for the visit have been agreed, they are visiting in August. Well, I should also mention that the decision to invite the working group was actually taken by the previous government, but no dates were decided upon. And this was something that was pending, and a decision had been made. The Special Rapporteur on the Promotion of Truth, Justice, Reconciliation, Reparation and Guarantees and Ron-recurrence was to visit in Sri Lanka, not in his mandate as special rapporteur on this area, but in terms of providing technical assistance, that is to discuss with the government of Sri Lanka about what our concerns are and to also if we require, provide advice and guidance on how he thinks we should approach certain issues and he visited Sri Lanka, as you know, and we have held discussions with him and we continue to remain engaged with him. Similarly we continue to remain engaged with civil society in Sri Lanka, as well as outside.
Q: Manjula, Sunday Observer. Canada has... it seems that Canada has revised its immigration laws in their country and there is concern that Sri Lankan expatriates will also be affected by this. Have you taken it up this with the mission there?
Spokesperson: Sorry, I...
Q: Have you taken it up with the mission there or...?
A: Well, Manjula, we have also read and heard about Canada having revised their immigration policy. But as you know, this is an internal matter for Canada and, therefore, it’s not our policy to talk about another country’s immigration policies. So, therefore we have not approached them on this subject.

Q: That is my first question. My second question is, when the treasury officials or the team visited the Geneva ... or conducted the management audit at our High Commission in Geneva, under what provisions were they appointed so on and so forth? And secondly, how often are management audits conducted and, under what provisions of law do you initiate management audits in one of our overseas missions?
A: On the first question, the Foreign Minister will be discussing a wide range of issues with Japan. Japan and Sri Lanka, as you know have maintained very good relations and have been friends for long years and they are also a member of the human rights council, but even if they weren’t, I think, we are close enough to be able to openly discuss all issues that concern our country and I assume that would happen. I cannot pre-judge what the discussions would be even before the discussions take place. But this is my assumption.
Number two was, I believe, on what, under what provisions that the audit team from the Ministry of Finance was appointed. This is the issue that I actually pointed out to you when I briefed you. Usually it’s not the Ministry of Finance that undertakes audits of this nature. It’s the Audit Department officials and we also have an Internal Audit Division in this Ministry, and as I quoted to you what Ms Tamara Kunanayagam has said in the media, that she telephoned the President and said that she has concerns about the security and the audit of the Mission, that she does not wish to go through the Ministry of Foreign Affairs and that she would like an Audit team to be sent, at which point the President, she says, had told her that he will ask ... send the audit team and that he had asked the Ministry of Finance to send an audit team and the audit team visited.
So, I don’t know, I mean, and, of course, I cannot pronounce on this, but there seems to be some irregularity in the way this audit team undertook this visit and whether they also have the mandate to do so is not something that I wish to comment on, but that is a question.
And the third question was how often do we conduct audits and so on. I don’t know the exact periodicity, but there are audits of missions that take place very regularly. There are audit teams that visit, I mean, these are actually consisting of audit officials, and not the officers of the Ministry of Finance and so on, but if you wish to have more information on that, we can obtain that for you.
Q: On the matter which Leader of the House Minister Lakshman Kiriella made, mentioned yesterday, about the visit of US President Barack Obama. As the Foreign Ministry who should be engaging in these sorts of visits with the State Department or with US authorities, what sort of a communiqué or communication has the Ministry of Foreign Affairs ...

Q: What sort of a communiqué or communication has the Ministry of Foreign Affairs has made with the US Departments or the authorities, in relation to US President, the Barack Obama’s visit to the Island?
A: Well, we have also heard what Minister Lakshman Kiriella has said. To be quiet frank, we are not aware of any plans ... we are not aware of any plans for such a visit by the US President and we are not aware of any timelines either. But we understand that there may be a possibility that the President may be visiting Asia towards the end of this year. This is a possibility, that we understand and if there is such a possibility, of course, Sri Lanka would welcome the consideration of a visit, especially, because no US President has ever visited Sri Lanka. But, as I said, we are not aware of any plans for a visit at this time by the US President.
Q: Has the Foreign Ministry had held any discussions any related to this matter?
A: No.
